SoarScope Terms of Service and Privacy Notice

1. Who we are

SoarScope (soarscope.app, identity.soarscope.app and soarscope.eu) is run by J. Schram, a private individual in the Netherlands. Contact: info@soarscope.eu.

By using SoarScope you accept these terms. If you do not agree, do not use SoarScope.

2. Safety

SoarScope is a forecast, in beta. A forecast is a model of the weather, not the weather. It can be wrong, late, incomplete or unavailable.

SoarScope is not an official aviation weather service. It does not replace official briefings, NOTAMs or your own judgement. As pilot in command, you decide whether, where and how far to fly.

• An empty area on the map means we have no data. It does not mean "no lift" or "safe".
• Potential flight distance (PFD) is not a promise and not a plan.
• Airspace and airfields are for orientation only and may be out of date. Do not use them to navigate.

3. Accounts

You must be 16 or older and use your own email address. Unconfirmed accounts are deleted after 7 days. You can delete your account at any time on the account page.

4. Use

You may not scrape or bulk download SoarScope, republish or resell the forecast, build another product on it, overload our servers, create accounts automatically, or break the law with it. Clubs and businesses must ask us before embedding SoarScope or using it for their business.

We may block access or delete accounts that break these rules, and we may change or stop SoarScope at any time.

The forecast is our work. It uses data from others under their own licences, credited at https://soarscope.eu/#sources.

5. Liability

SoarScope is free and in beta. We do not promise it is correct, complete or available, and we are not liable for damage from using it or not being able to use it.

This does not apply to damage caused by our intent or gross negligence, to death or personal injury where the law does not allow us to limit liability, or to any liability that cannot be limited by law. Consumers keep all mandatory rights of their own country.

For business and club users, our liability is limited to the amount paid to us in the 12 months before the damage, with a minimum of EUR 100, except for intent or gross negligence.

6. Changes

We may update these terms at any time. If you have an account, you are asked to accept the new terms the next time you sign in. If you do not accept them, you can delete your account. Without an account, you are asked to accept them the next time you open the app.

7. Law

Dutch law applies. Disputes go to the competent court in the Netherlands. Consumers in another EU country keep the protection of their own country's mandatory rules and may also go to their local court.

8. Privacy

J. Schram is the controller of your personal data. Contact: info@soarscope.eu.

Processors: Hetzner Online GmbH (hosting, servers in Europe) and Microsoft (email and "Sign in with Microsoft"). Microsoft may process data outside the EEA, protected by the EU Standard Contractual Clauses and the EU-US Data Privacy Framework.

Your rights: you can ask to see, correct, delete, limit or receive your data, and object to use based on legitimate interest. Mail info@soarscope.eu; we reply within one month. You can also complain to the Autoriteit Persoonsgegevens or your own country's authority.
